1. Agreement and Acceptance
These Terms of Use ("Terms") govern your use of the MathCraft website at https://crafterapps.com/apps/mathcraft/ (the "Site") and our iOS application MathCraft: ThinkFast Math (the "App"). By downloading, installing, accessing, or using the App or Site in any way, you expressly agree to be bound by these Terms. If you do not agree to all of these Terms, you must not download, install, access, or use the App or Site.
2. Educational Purpose and License
MathCraft: ThinkFast Math is an educational app designed to help users improve their mathematics skills through adaptive practice and gameplay. We grant you a personal, non‑exclusive, non‑transferable, revocable license to use the App solely for personal, educational, and entertainment purposes on Apple‑branded devices you own or control, in accordance with the Apple Media Services Terms and App Store policies.
3. User Eligibility and Parental Consent
- Age requirements: You must be at least 13 years old to use the App independently and agree to these Terms on your own behalf.
- Children under 13: Children under 13 may only use the App under the direct supervision of a parent or legal guardian who has read and agreed to these Terms on the child's behalf.
- Parental responsibility: Parents and legal guardians are fully responsible for: (a) determining whether the App is appropriate for their child, (b) supervising their child's use of the App, (c) monitoring and authorizing any in-app purchases, and (d) ensuring compliance with these Terms.
- Educational supervision: We recommend that parents participate in their child's educational experience with the App and monitor their progress and usage patterns.
4. In-App Purchases and Parental Controls
- Pro unlock: The App offers an optional one-time Pro unlock ($4.99 USD) via Apple's in-app purchase system, which provides enhanced analytics and insights features.
- Parental authorization required: All in-app purchases must be authorized by the account holder (parent/guardian for children's accounts). Parents are responsible for managing purchase restrictions through Screen Time and Family Sharing settings.
- Apple billing: All billing, payment processing, transaction records, and refunds are handled exclusively by Apple according to their App Store policies and terms.
- Family Sharing: The Pro unlock supports Apple's Family Sharing, allowing family members to share the purchase. Parents control Family Sharing settings.
- Price variations: Prices may vary by region and are subject to change without notice. Current pricing is displayed in the App Store.
- Refund policy: Refunds are handled by Apple through their "Report a Problem" system. Contact Apple directly for refund requests; Crafter Apps cannot process refunds.
5. Privacy
Our Privacy Policy at https://crafterapps.com/apps/mathcraft/privacy.html explains how we handle information. By using the App or Site, you consent to our privacy practices, which include collecting no personal data.
6. Acceptable Use and Educational Guidelines
- Permitted use: You may use the App only for lawful, personal, educational, and entertainment purposes in accordance with these Terms.
- Educational intent: The App is designed for mathematics education and skill development. Use should align with educational goals and appropriate learning practices.
- Technical restrictions: You may not reverse-engineer, decompile, disassemble, or attempt to derive source code from the App, or circumvent any security measures.
- Legal compliance: You must comply with all applicable local, state, national, and international laws and regulations while using the App.
- System integrity: You may not attempt to interfere with, damage, or impair the App's functionality, create derivative works, or introduce malicious code.
- Automation prohibited: You may not use automated systems, bots, scripts, or any artificial means to interact with the App.
- Parental guidance: Parents should ensure their children's use of the App aligns with family values and educational objectives.
7. Content and Conduct
The App does not allow user-generated content, social features, or communication between users. All content is provided by Crafter Apps for educational purposes.
8. Intellectual Property
- All rights, title, and interest in and to the App, Site, and related content are owned by Crafter Apps or its licensors.
- The App name "MathCraft", logos, and trademarks are proprietary to Crafter Apps.
- You may not copy, modify, distribute, or create derivative works of the App or its content.
- For copyright infringement claims, contact legal@crafterapps.com with detailed information per DMCA requirements.
9. Disclaimers & Limitation of Liability
- The App and Site are provided "as is" without warranties of any kind, express or implied.
- We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
- To the fullest extent permitted by law, Crafter Apps shall not be liable for any indirect, incidental, consequential, or punitive damages.
- Our total liability shall not exceed the amount you paid for the App (maximum $4.99 USD).
- Some jurisdictions do not allow limitation of certain warranties or liabilities, so some limitations may not apply to you.
10. Termination
- We may terminate or suspend your access to the App at any time for violation of these Terms.
- You may stop using the App at any time by deleting it from your device.
- Upon termination, your license to use the App ends immediately.
- Provisions regarding intellectual property, disclaimers, and limitation of liability survive termination.
11. Governing Law and Dispute Resolution
- Governing law: These Terms are governed by the laws of France, without regard to conflict-of-laws principles.
- Jurisdiction: Any disputes shall be resolved in the courts of France, except as noted below.
- EU consumer rights: If you are a consumer in the EU, you may also have the right to bring proceedings in your country of residence.
- Arbitration: For disputes under $10,000 USD, you and Crafter Apps agree to resolve disputes through binding arbitration rather than in court, except where prohibited by law.
- Class action waiver: You agree to resolve disputes with us only on an individual basis and not as part of a class action or representative proceeding, where legally permissible.
- Parental disputes: Disputes involving minors must be brought by their parent or legal guardian on the minor's behalf.
12. Changes
We may update these Terms periodically. We will notify users of material changes through the App or this Site. Continued use after changes constitutes acceptance of the modified Terms.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
