Terms of Service
Please read these Terms of Service ("Terms") carefully before using SmartQR ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using SmartQR, you agree to be bound by these Terms and the Privacy Policy. If you do not agree to these Terms, please do not use the App.
2. Age Requirement
You must be at least 13 years old to use SmartQR. By using the App, you represent that you are at least 13 years of age. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.
3. Description of Service
SmartQR is an application for creating, customizing, organizing, scanning, and measuring supported QR codes. The App requires iOS or iPadOS 18 or later and is also available on compatible Macs as an iPad app. It offers free local features and subscription-based Pro features, including:
- QR code creation and customization
- QR code scanning
- Aggregate scan totals and latest scan time for supported codes (Pro)
- Editable Smart Link destinations for supported codes (Pro)
- Reports, widgets, advanced export, and organization tools (Pro)
4. User Accounts
You do not need to create an account with a username or password for local QR workflows. Anonymous Firebase authentication is created only when a verified Pro user activates a backend-required feature such as aggregate scan analytics or Smart Links. Optional iCloud sync is associated with your Apple ID and is operated by Apple.
5. Subscriptions and Payments
SmartQR Pro is available as an auto-renewable subscription. By subscribing:
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel subscriptions in your Apple ID account settings
- Any unused portion of a free trial period will be forfeited when purchasing a subscription
6. Acceptable Use
You agree not to use SmartQR to:
- Create QR codes that link to illegal, harmful, or malicious content
- Engage in any activity that violates applicable laws or regulations
- Attempt to circumvent any security features of the App
- Use the App for spam, phishing, or fraudulent purposes
- Infringe on the intellectual property rights of others
7. Third-Party Services
The App uses the following third-party services:
- Firebase (Google) – for verified Pro Smart Links, aggregate scan counters, minimal subscription verification, anonymous backend identity, and cleanup. Firebase stays off for free and local-only workflows. Use is subject to Firebase Terms of Service.
- Apple – for subscription billing (via App Store) and iCloud sync. Use is subject to your Apple Media Services Terms and Conditions.
I am not responsible for the practices or policies of these third-party services.
8. Intellectual Property
The App, including its design, features, and content, is owned by me and protected by intellectual property laws. You retain ownership of the QR codes you create and their associated content.
9. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind, either express or implied. I do not guarantee that the App will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App.
11. Changes to Terms
I reserve the right to modify these Terms at any time. I will notify users of significant changes through the App or by other means. Your continued use of the App after changes constitutes acceptance of the new Terms.
12. Termination
I reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that I believe violates these Terms or is harmful to other users or third parties.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
14. Apple App Store Terms
The following terms apply to your use of the App through the Apple App Store:
- These Terms are between you and me, not Apple. I am solely responsible for the App and its content.
- Apple has no obligation to provide maintenance or support services for the App.
- Apple is not responsible for any product warranties, whether express or implied. I am solely responsible for any claims relating to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, or claims under consumer protection or similar legislation.
- Apple is not responsible for the investigation, defense, settlement, or discharge of any intellectual property infringement claim.
- You must comply with any applicable third-party terms when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
15. Your Data Rights
You have the right to request deletion of your data at any time. See my Privacy Policy for details on how to exercise this right and what data is collected.
